Immersion responds to Microsoft's lawsuit - Image 1Immersion Corporation has finally responded to Microsoft's new lawsuit concerning the rumble maker's settlement with Sony. If you missed our last report, the whole fiasco involves Microsoft' claiming that Immersion owe them part of the settlement fee the latter got from Sony.

Now Immersion is saying that Microsft has already received its share. It was reported that Sony paid Immersion around US$ 150 million. However, things get tricky if you've read Immersion's official filing with U.S. Securities and Exchange Commission (SEC). A part of that said filing reads,


Our net income was US$ 122.4 million for the three months ended March 31, 2007... The increase in net income was primarily due to the litigation conclusion and patent license from Sony Computer Entertainment of US$ 119.9 million and the extinguishment of the liability to Microsoft of US$ 15.0 million.


As you've read, the money that was given to Immersion is being classified under "litigation conclusion and patent license." One can easily assume that these words translate to settlement but you all know how litigations go - everything depends on the interpretation of documents.

We are not entirely sure if Microsoft sued immersion because its lawyers interpreted this differently, meaning there's more money behind these. However, the father of rumble technology is keeping firm with its earlier stand saying,


Immersion believes that it is not obligated under the sublicense agreement with Microsoft to make any payment to Microsoft relating to the conclusion of its litigation with Sony Computer Entertainment. Immersion intends to defend this lawsuit vigorously.

That's pretty ballsy for Immersion. Whether they're in the right or not, I'm still giving kudos to them for telling the sue-happy M$ which hole to put their lawsuit in.

If the money rightfully belongs to you, which seems to be the case here (Immersion does owe MS money), wouldn't you pursue it? Regardless of how much money you already have? Money is money after all, in today's world you can never have too much of it.

When your net profits for a year are 90% because of lawsuits, you really shouldn't be telling someone how to litigate.

Doesn't sound like the kind of company I'd invest in. What if they didn't have anyone to sue next year?

yea i wouldnt invest into immersion too. They're too unstable and the only source of income they have is from their patents. No real advancement from immersion. Although if you count it as a long term investment, they'll probably turn rumble to force feedback or something more intense on controllers and then stock prices would go up.

ps3 is so awesome... i wish i had one... but my parents said they wouldn't buy one for me cuz im 8 and i cant spell.... and we're poor too..... i had to settle for a crappy 360 that overheats all the time......

I'm somewhat confused right now by this xman vs. xman thing going on right now lol (But I can guess who's the real one that laughs at Sony like an loser). Guys, can't we all just get along? By the way, to whichever xman that posted the comment seems to suggest that people who like PS3's can't spell, I've got a PS3 lol andt i cabn tipe gould (rofl, I DO have a PS3 though, I prefer it over the 360). Also, to stay on topic: Microsoft, I don't quite understand why you're making a lawsuit against Immersion... maybe I missed something when I first read the article. Also, I don't know if this is of any importance to the story, but didn't Sony create a gaming console that used rumble before Microsoft did? I'm really confused right now...
