this is what i hate about american small business. This company has a PATENT not an actual product, they have a patent that shows they "own" the technology but they dont need a device to prove it. They try to find other companies that infringe on it and then htey go sue sue sue. Most of these companies are not even known thus making big companies real targets since they make a lot of products and chances are they will use a general technology like this.

If you are in that situation why buy a 360? Most of the great games on the 360 are coming out with a PC counterpart, while almost none of the PS3 titles have a PC counterpart. So having a PS3 and a PC solves the problem of wanting to play all you the games you want. TY M$ for allowing me to not invest in your console :)

(1) To my point 1 above:

I don't have any answer for this. For this, I can only say that the only Companies that benefit from this particular demand (IMPOUNDING and/or DESTRUCTION, and thus discouraging sales of PS3) are Microsoft and Nintendo. Again, Nintendo is in a VERY strong position and has nothing to fear from Sony, which leads me to the conclusion that the only Company benefiting from the FUD regarding the PS3 created by this lawsuit is Microsoft (Business history is evidence that Microsoft rarely, if ever, plays fair in the world of business).
On the other hand, I might be mistaken. Any counters?

It may have just occurred to the person/Company that IBM/Sony's product might infringe on their patent. Or they might have been biding their time until Sony starts to approach something like a good position.

I don't have any answer for this. For this, I can only say that the only Companies that benefit from this particular demand (IMPOUNDING and/or DESTRUCTION, and thus discouraging sales of PS3) are Microsoft and Nintendo. Again, Nintendo is in a VERY strong position and has nothing to fear from Sony, which leads me to the conclusion that the only Company benefiting from the FUD regarding the PS3 created by this lawsuit is Microsoft (Business history is evidence that Microsoft rarely, if ever, plays fair in the world of business).
On the other hand, I might be mistaken. Any counters?

it really is a shame that lawsuits and suing has become such a trend in north america. it seems to be the only get-rich scheme for companies that struggle to stay afloat.
...and to the fanboys.. despite how you feel about each system.. they are both good in their own respects, but would you really desire a monopoly of systems? zero-competition is only asking for more trouble. that is more of your hard earned (or your parents' hard-earned money for that matter) money going to waste.
i am sure there is a lot of facts/truth in both ps3 and xbox's viability as systems.. but i get the feeling that people are just trying to justify their expensive purchases. i don't blame anyone - i spent quite a bit for my set up too.

Sueing for something they patened way back in '91, & they claiming that Sony stole their idea. 1st of all, Sony didnt make the cell, so how culd they win the case if Sony didn't make it?. And if they were to sue Sony.. IBM, Toshiba, & Microsoft wuld be in it too. Like Destroyer said earlier, Microsofts CPU share memory too. 4 major companys againts one little one. Not that I am a 360 fan, but the Xenon is a different technology than the Cell Processor. True that both chips may have the same function but it all differs in buffer, I/O, pipelining, register handling, as well as multi-threading. So the company, Parallel Processing Corporation, is suing Sony because their so called "PATENT" matched the technology of the Cell Processor, not how the processor functions.
It's like the rumble function of Nintendo. Wondered why it was not sued by any lawsuits? because Nintendo did not use the same technology as the Sony and Microsoft did.
